Terms of Use

Effective date: 24 October 2026 · Last updated: 24 October 2026

These terms apply to your use of the Health Data Bot iPhone app (the “App”), the Health Data Bot connector service (the “Service”) and this website. The App and Service are provided by Health Data Bot (“we”, “us”). Legal entity details: TBD – legal name and registered business details.

The App is licensed to you under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add to the Standard EULA. If they conflict, the Standard EULA prevails to the extent of the conflict, except where these terms give you more rights. By using the App or Service, you agree to these terms and our Privacy Policy.

1. Not medical advice

Health Data Bot is a data-sharing tool. It is not a medical device and does not provide medical advice, diagnosis, treatment or monitoring. Do not use it, or anything an AI assistant tells you using its data, as a substitute for advice from a qualified health professional. Do not delay seeking care or disregard professional advice because of something you read. In an emergency, call your local emergency number (000 in Australia).

2. The Service

  • The App reads Apple Health data you allow, calculates summaries on your iPhone and uploads them to the Service. The Service makes that data available, read-only, to AI assistants you connect using your personal connector link.
  • Data may be incomplete, delayed or inaccurate. It depends on the devices and apps that recorded it, your Health permissions, and iOS background limits. We don’t guarantee that data is complete, current or error-free.
  • We may change, add or remove features. We will try to give notice in the App of significant changes that reduce what a paid subscription provides.
  • The Service relies on third-party systems (including Apple, Cloudflare and your AI providers). We aim for high availability but don’t promise uninterrupted service.

3. Subscriptions and payment

  • Using the Service requires an auto-renewable subscription purchased through the App Store. Each subscription provides one active connector link (“connection”).
  • Indicative prices are US$1.99 per month or US$19.99 per year per connection. The price that applies is the one shown in the App Store before you confirm your purchase, in your local currency and including applicable taxes.
  • Payment is charged to your Apple Account at confirmation of purchase. Your subscription renews automatically at the same price and period unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel your subscription in your Apple Account settings (Settings > your name > Subscriptions). Cancellation takes effect at the end of the current period. Deleting the App or your data does not cancel your subscription.
  • If we offer a free trial or introductory price, any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
  • Billing, payment and refunds are handled by Apple under its terms. Request refunds from Apple at reportaproblem.apple.com. Nothing in this section limits your rights under the Australian Consumer Law (see section 8).
  • If your subscription lapses, AI assistants will no longer receive your data. Stored data remains until you delete it or as described in our Privacy Policy.
  • If we change subscription prices, Apple will notify you and, where required, ask for your consent before the new price applies.

4. Your account and connector link

  • Your account is anonymous and tied to your installation of the App. You are responsible for keeping your iPhone and your connector link secure.
  • Anyone with your connector link can read the health data shared through it. If you think it has been exposed, create a new link in the App straight away.
  • You must be at least 16 years old (or the age of digital consent where you live, if higher) to use the App.
  • You may only connect your own health data, or data you have the right to share.

5. Third-party AI assistants and AI outputs

  • AI assistants such as ChatGPT, Claude, Gemini and Grok are provided by third parties, not by us. Your use of them is governed by their own terms and privacy policies. We are not responsible for their availability, features, data handling or conduct.
  • When you connect an assistant, you direct us to send it your health data on request. Once sent, it is outside our control.
  • AI outputs may be inaccurate, incomplete, misleading or inappropriate. Assistants can misread data, make calculation errors or invent information. We do not create, review or control AI outputs and are not responsible for them. Check important information and consult a qualified professional before making health, fitness, nutrition, medication or other decisions.
  • Whether a given assistant supports connectors depends on its provider, your plan and your region, and may change at any time. We can’t guarantee compatibility with any particular assistant.

6. Acceptable use

You must not: misuse, overload, probe or attempt to gain unauthorised access to the Service or other users’ data; reverse engineer the App or Service except as permitted by law; resell or redistribute access to the Service; upload data you are not entitled to share; or use the Service unlawfully. We may suspend or end access for serious or repeated breaches, and will refund any amount required by law.

7. Intellectual property

We (and our licensors) own the App, Service, website and the Health Data Bot name and branding. Your health data remains yours. You give us permission to store and process it only as needed to provide the Service as described in our Privacy Policy.

Apple, Apple Health, HealthKit, iPhone and App Store are trademarks of Apple Inc. ChatGPT is a trademark of OpenAI, Claude of Anthropic, Gemini of Google LLC, and Grok of xAI. Health Data Bot is not affiliated with, sponsored or endorsed by Apple or any AI provider.

8. Australian Consumer Law and your statutory rights

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the ACL or any other law that cannot lawfully be excluded or limited (“Non-Excludable Rights”). Consumers in other countries may also have rights under their local law that these terms cannot override.

9. Disclaimers and limitation of liability

Subject to your Non-Excludable Rights:

  • the App and Service are provided “as is” and “as available”, and we exclude all warranties and conditions not expressly set out in these terms or the Standard EULA;
  • we are not liable for any loss arising from AI outputs, decisions you make based on them, the acts or omissions of third-party AI providers, or disclosure of data through a connector link you shared or failed to keep secure;
  • we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or goodwill; and
  • where our liability for failure to comply with a consumer guarantee can lawfully be limited, it is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

Otherwise, to the extent permitted by law, our total liability to you in connection with the App and Service is limited to the amount you paid for your subscription in the 12 months before the claim arose. These limits do not apply to liability for death or personal injury caused by our negligence, or for fraud, or where they are not permitted by law.

10. Ending these terms

You can stop using the Service at any time by deleting your account in the App and cancelling your subscription through Apple. We may stop providing the Service by giving reasonable notice in the App, and will provide any refund required by law. Sections that by their nature should survive will continue to apply.

11. Changes to these terms

We may update these terms from time to time. We will post the new version here with a new “Last updated” date and give notice in the App of material changes before they take effect. If you don’t agree, you can stop using the Service and cancel your subscription.

12. Governing law

These terms are governed by the laws of TBD – state or territory, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you are a consumer living elsewhere, you also keep the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts.
